Paid daily fantasy sports contests may not be legal in the state of Nevada, but that hasn't stopped the biggest DFS provider on the planet from coming to the state. On Wednesday, DraftKings officially opened an office in Las Vegas.

The company's president and co-founder, Matt Kalish, as well as race and sports director Johnny Avello welcomed guests to the new office at Town Square, where 70 employees will begin work immediately. As many as 300 employees may move into the office in the coming months.

In a few months, DK's Vegas office is expected to be the company's second largest headquarters in the United States behind its Boston operation.

DraftKings' employees officially began work in the new space on Monday, where a call center has already been opened dedicated to customer experience, sportsbook traders, fraud, human resources, information technology and casino matters.

DraftKings' Sports Betting Focus

DraftKings has yet to open a sportsbook or launch its mobile betting app in Nevada, and Kalish says there is no firm timetable on when the company will do so. DraftKings decided to get into the realm of sports betting shortly after the United States Supreme Court decided to strike down the Professional and Amateur Sports Protection Act (PASPA) in May of 2018.

Since then, the company has launched its mobile sports betting app in Pennsylvania, New Jersey, Indiana, West Virginia and New Hampshire. DraftKings also operates land-based sportsbooks in New York, New Jersey, Mississippi and Iowa.

DraftKings is not currently licensed to operate in Nevada, and Kalish said that the company has not decided how it will go about opening a retail outlet or secure the necessary licensing.

The state of Nevada requires a person to appear in person to sign up in order to establish a mobile gaming account. So far, nobody from DraftKings has done so. That process is different than the process required in other states. DraftKings already has agreements in place with Caesars Entertainment Corp. and Penn National Gaming.

Avello officially signed on with DraftKings in October of 2018 after spending years working as the sportsbook director at Wynn Las Vegas. Avello has since put together a team of professionals with plenty of experience working at several different Vegas-based sportsbooks.

DraftKings' Troubles in Nevada

DraftKings has reportedly had interest in operating in Nevada for at least 5 years. However, back in 2015, the Nevada Gaming Control Board determined that daily fantasy sports contests are a form of gambling. Regulators then required DraftKings, FanDuel and other DFS platforms to cease operations in Nevada unless they managed to secure the proper licensing.

Representatives from both DraftKings and FanDuel unsuccessfully lobbied with the Nevada Gaming Policy Committee in order to recommend a special DFS license to the state's legislature.

Caesars Partnership is Key

DraftKings officially announced its aforementioned partnership with Caesars in February of 2019. As a part of the agreement, Caesars grants DraftKings market access for the company's online gaming products subject to the passage of necessary laws. Caesars has also maintained a relationship with the NFL, which has already endorsed daily fantasy sports as a game of skill rather than a game of chance (gambling).

DraftKings officially unveiled its sports betting app shortly after New Jersey legalized sports betting in 2018. The company has since gone on to become a leader in the industry in the state. However, FanDuel has surpassed DraftKings in terms of gross gaming revenue in New Jersey as of December 2019.

DraftKings' progression into Nevada could see a boost in the coming months with Caesars expected to merge with Reno-based Eldorado Resorts Inc. Once the $17.3 million pact is officially approved by the state, Caesars will operate almost 60 properties across 18 different states. Many of those states have already legalized sports betting, while others are expected to do so in the coming months and years.

'From our humble origins less than a decade ago, out of a Massachusetts spare bedroom, it is both thrilling and surreal to now have Las Vegas join DraftKings' team of offices,' DraftKings co-founder and president of North America, Matt Kalish, said.

'This new space further exemplifies our continued investment in the success of our company and employees as we establish our technological prowess within one of the world's top entertainment destinations.'

The combined SBTech-DraftKings business has set an aim of creating what it described as 'the only vertically integrated pure-play sports betting and online gaming company' based in the US.

However, it was also revealed last week that DraftKings made a loss of $114.1m in the first nine months of 2019, with revenue for the period amounting to $192.0m.

The document also confirmed that DraftKings will – eventually – migrate from its current sportsbook technology partner Kambi to SBTech's solution. Diamond Eagle did not provide a timeline for when this process would start or finish, but did suggest it would continue to use its technology until December 2020.
